To approve the proposed modifications to the Vale of Aylesbury Local Plan which respond to issues that have arisen during the examination.
The proposed modifications consist of ‘main modifications’ (which materially affect the Plan’s policies) and ‘additional modifications’ (which are of a more minor nature: for example, to correct typographical errors or make consequential changes). The proposed modifications have been amended in response to points made by the VALP Inspector on the version that was sent to him for consideration in July 2019. These are set out in a Table of Corrections and incorporated into an updated Table of Proposed Modifications. The documents also include a number of minor changes identified by officers, for example to correct numbering or other formatting errors.
Following the Council’s request under section 20(7C) of the Planning and Compulsory Purchase Act 2004 for the Inspector to recommend main modifications as necessary to make the Plan sound and legally-compliant (letter dated 7 September 2018), the Council prepared a comprehensive list of proposed modifications.
The proposed modifications respond to issues raised during the examination including the Inspector’s questions, discussion documents, actions identified during the hearing sessions, the Inspector’s interim findings and subsequent correspondence.
The modifications are based on updated evidence where appropriate including an Addendum to the Sustainability Appraisal. They consist of ‘main’ and ‘additional’ modifications as explained below.
The modifications must be approved under agreed delegation arrangements before then can be sent to the Inspector and published.
The modifications were sent to the Inspector for his consideration in July 2019 to ensure he was reasonably satisfied that the main modifications are necessary to rectify the unsoundness problems that have already been identified in the examination so far. The Inspector gave his comments on the proposed modifications in August 2019, and amendments have been made as necessary.
The main modifications will be published by the Council for six weeks public consultation to give the opportunity to comment in October / November 2019.
To not approve the proposed modifications, which would mean that the Vale of Aylesbury Local Plan could not progress further and would have to be withdrawn.
